This position provides general operations, compliance, privacy, and consumer finance counseling to the Company’s various business units and field operating divisions. This position will have counseling responsibilities related to operating divisions within the field, including providing advice on customer disputes and other general legal guidance for store operations. This position will also work with others within the Legal and Compliance organizations to advise the company on bankruptcy issues, account renewals/collections, privacy matters, payment regulations, contracts, consumer-facing issues, and various federal and state-level regulatory and statutory compliance matters.
Duties and Responsibilities:
·Provide legal advice and services to the area directors, regional managers, and general managers for store operations and operating divisions including counseling related to customer issues, customer contracts, account renewals/collections, etc. To be successful in this area, it is necessary to develop and maintain a good working relationship and a high level of trust with the management of the operating divisions.
·Evaluate and assess the legal compliance and counseling needs of stores and operating divisions. In collaboration with the Compliance Department, this individual will assist with legal training needed for store operations and other functions.
·Together with other members of the Legal Department, the Compliance Department and with other functional departments, advise on compliance with applicable state and federal laws, rules and regulations relating to consumer protection including bankruptcy laws, the Telephone Consumer Protection Act, the Fair Credit Reporting Act and Fair Debt Collection Practices Act, and state collections laws.
·Conduct complex legal research and serve as a resource for privacy, security, payments, and consumer finance issues, including privacy laws, HIPAA, CAN-SPAM Act, Red Flags, state privacy and state data breach laws, etc. Participate in privacy and data security related investigations, participate in annual risk assessments, and help develop work plans to address identified risks, including auditing and monitoring activities.
·Juris Doctor from accredited law school and 5+ years of experience in a law firm or corporate legal department with experience in privacy, data security, consumer finance, and bankruptcy/collections.
·Some litigation experience preferred. Licensed to practice law in a U.S. state, preferably Georgia.
·Experience responding to inquiries from regulatory agencies, consumers, customers, and the business community.
·Experience handling and resolving corporate regulatory compliance and privacy incidents and issues.
·Ability to handle multiple projects with critical deadlines and competing priorities.
·Ability to develop creative solutions to liability exposure in the context of a consumer-facing business.
·Ability and experience in implementation and drafting of policies and procedures.
·Ability to build relationships, communicate effectively, openly share knowledge, and collaborate with business units, other in-house attorneys, and outside counsel.
